WEBSITE DESIGN TERMS AND CONDITIONS
Brief, delivery and deadlines
The client is responsible for providing Redline Company with all materials required to complete the site to the agreed standard and within set deadlines (Except for retainer clients, in which case Redline will work with the client to produce the required content and graphics). Redline Company will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
Quality control
Whilst every endeavour will be made to ensure that the website, any scripts or programmes are free of errors, Redline Company cannot accept responsibility for any losses incurred due to malfunction of the website or any part of it.
Redline Company will carry out a full quality control prior to delivering the website to the client. It is the client’s responsibility to test fully any application or programming related to a site developed by Redline Company before it is made generally available for public use.
Where “bugs”, errors or other issues are found after the site is live, within the first 3 months of ‘going live’ Redline Company will endeavour (but is not obliged) to correct these issues to meet the standards of function outlined in the brief. Redline Company will not be obliged to correct any issues which could have been caused by either the client or third parties altering HTML coding, other scripts and programming.
Redline Company cannot be held responsible for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
Third parties
Where applications or sites are developed on servers not recommended by Redline Company, the onus is on the client to provide or seek any information, additional software support or cooperation pertaining to the server in order for the application or site to function correctly.
Redline Company will issue the client with any relevant login details and passwords. It is the client’s responsibility to keep the passwords and login safe and not to divulge them to a third party.
Hackers
Redline Company cannot be held responsible for any losses as a result of the site being hacked. In the event that a site or database is hacked, Redline Company will be available to assist in securing the site during normal office hours between 10.00 and 18.00 Monday to Friday. In the event that there is a serious exploitation and files are badly infected, there will be an additional cost to get the website up and running again, as we might have to re-build the site if the backup version files also have the hacked files. This service will be charged at 55€ per hour.
Handover
Redline Company will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents (third parties). Redline cannot be held responsible for any issues or losses caused by plugins or updates carried out by third parties.
Redline Company will provide 1 hour of basic training upon the delivery of every website included in the cost. The basic training will include a) login procedure b) uploading text c) uploading images and d) uploading blogs. Any further training will be charged at an hourly rate of 55€ + IVA.
Additional information
The website, graphics and code remain the property of Redline Company until all outstanding accounts are paid in full.
All applications, scripts and software written by Redline Company remain the copyright of Redline Company and may only be reproduced and resold with the permission of Redline Company.
